The Institutions Behind Property Transactions in Portugal

Property transactions in Portugal are supported by a network of public institutions that ensure transparency, legal security, and proper registration of ownership. Understanding the role of these entities helps buyers and sellers appreciate how the system works and why property ownership in Portugal is strongly protected by law.

Autoridade Tributária (Portuguese Tax Authority)

The Portuguese Tax Authority manages all property-related taxes, including IMT (Property Transfer Tax), Stamp Duty, and annual property tax (IMI).

These taxes must be calculated and paid before certain stages of the transaction can proceed, particularly before the final deed is signed.

How I Guide You:

I help you understand when these taxes apply and coordinate with the professionals handling the transaction to ensure all tax obligations are completed on time.

Conservatória do Registo Predial (Land Registry)

The Land Registry is responsible for recording and maintaining the official ownership of all property in Portugal.

Every property has a registry record that identifies the owner and lists any mortgages or legal charges attached to it.

Why This Matters:

This system ensures transparency and allows buyers to verify the legal status of a property before purchasing.

Câmara Municipal (Local Municipality)

Each municipality is responsible for issuing documents related to the construction and legal use of buildings.

This includes the Licença de Utilização, which confirms that a property is legally approved for residential or commercial use.

Why This Matters:

Without this approval, certain property transactions cannot be completed.

ADENE — Portuguese Energy Agency

ADENE regulates the Energy Performance Certificate system.

Certified technicians accredited by ADENE issue the Certificado Energético, which evaluates a property's energy efficiency.

Why This Matters:

This certificate is legally required before a property can be marketed or sold.

Notary or Property Registry Offices

In Portugal, the final transfer of ownership takes place through a formal property deed signing, known as the Escritura Pública de Compra e Venda.

This signing can take place before a notary or at a land registry office authorized to perform property transactions.

Why This Matters:

This step officially transfers ownership from seller to buyer.

Banco de Portugal & Commercial Banks

Banks play an important role in property transactions when buyers use mortgage financing.

They evaluate the buyer’s financial capacity, conduct property valuations, and issue mortgage approvals.

Why This Matters:

Bank financing must be fully approved before the final property deed can take place.
